Bicycle Helmet Requirements


It is against the law for any person under the age of 18 years of age to operate a bicycle or ride upon a bicycle as a passenger, on a street, bikeway, public bicycle path, or trail unless that person is wearing a properly fitted and fastened bicyclehe lmet. This requirement also appices to a person who rides upon a bicycle while in a restraining seat that is attached to the bicycle or in a trailer towed by the bicycle.

The first time an individual receives a ticket for this violation it will be dismissed in open court when the person alleges in court, under oath, that he has never received a ticket for this violation unless it is established in court that htis is not hi s first ticket for this violation.
Any subsequent ticket issued for this violation is punishable by a fine not to exceed $77
