Minor in possession of Tobacco

It is illegal for any person under the age of 18 years to purchase, receive, or possess any tobacco, cigarette, cigarette papers, or any other preparation of tobacco or any other instrument or paraphernalia that is designed for the smoking of tobacco, products prepared from tobacco, or any controlled substance. The maximum penalty imposed by the Court for violating this law is a fine of $75 or 30 hours of community service work.

In Ventura County, these violations are handled through the probation department, not the Court. The first time a minor receives a ticket for possession of tobacco, the minor and his/her parent must attend a substance abuse class held in the evening thro ugh the Probaation department.

The second time a minor receives a ticket for the same violation, the probation department will require you to work some type of community service. The minor could be asked to contact the American Lung Association. Another option that is very popular wi th youngsters is making a donation to charity, such as, the American Cancer Society, D.A.R.E., or the American Lung Association.
